Terminating your lease

For Tenancy


Requisite advance notice to quit

Either party to give a 3-month notice to terminate tenancy, (3 months start from date of letter), except for


Tenants may deliver vacant possession earlier prior expiry of notice when premises is reinstated to original condition. For newly allocated premises, keys may be returned, subject to recovery of 2-month rent-free period in lieu of minimum 2-month occupation from date of tenancy commencement.  

Rent

Rental shall be computed up to the date of receipt of keys, [eg. if keys are returned on 4th of Oct 2004, rental shall be charged up to 4th of Oct.]

Reinstatement

Outgoing tenant is required to reinstate the premises to its original condition, terminate all utilities supply before handover. Consideration could be given to allow outgoing tenant not to reinstate the premises to its original state so that the incoming tenant can continue to use the fixtures, subject to terms and conditions eg works are in order and authorised, etc.

Indemnity

Once termination notice given, tenants are liable to indemnify HDB for costs/claims incurred by HDB if they fail to deliver vacant possession on time. Only authorised persons are allowed to return the keys and sign the indemnity.

Over stayer

Tenants who return to occupy their premises illegally shall be imposed a penalty.

How to

  1. Complete and submit the online Termination request form (requires login with Singpass)
  2. You will receive an instant acknowledgement letter on your termination request
  3. You will also need to:
    1. Reinstates premises to original condition except for blocks due for demolition.
    2. Clear all trade refuse
    3. Disconnect water & electricity supplies; and remove meters & appliances (Singapore Power Ltd.)
    4. Redirect Mails (SingPost)
    5. Mail in the Letter of Authorisation (for Partnership) or Company's Resolution to HDB.
  4. Upon receive of document, HDB fix appointment date/time for termination on-site
  5. Tenant return keys to HDB officer on-site
  6. Tenancy Terminated
  7. HDB refund of excess deposit, if any, to tenant

For Land


You are required to pay land rent (for lessees on rental scheme) up to the date of delivery of vacant possession of the subject land property to HDB for terminating your lease prematurely and the following liquidated damages:
